Information Governance: Looking Ahead at eDiscovery in 2014

Every New Year brings opportunities, and for those of us in the legal community, it brings LegalTech as well.  Many of us will soon be gathering in New York City, which has me thinking about what we can expect to see in 2014.

A few trends come to mind based on what we are currently seeing in the market. First, eDiscovery is clearly moving to the Cloud – maybe not to something like the ‘cloud’ that Amazon offers, but to hosted, secure environments where legal and IT teams do not have to manage hardware and software.

 

Second, is Bring Your Own Device. This has been a hot topic due to the data collection and preservation challenges that I am already seeing panels on at LegalTech.

 

Third, is limiting scope, cost, and response times to legal matters and investigations. This can be achieved a number of ways through legislation, party agreement, case law, and/or technology. If I know the legal industry, my bet would be on technology as the driver. Proactive information governance where ESI is pre-collected, stored, and classified would be a step in the right direction. Will 2014 be the year that organizations regain control of their data?
